  1. Purpose Limitation, Legal Basis, Storage Period, and Data Recipients

3.1. We require the collected personal data for contract fulfillment, billing, assertion of contractual claims, for customer service purposes, and for advertising purposes. The data is collected, stored, processed, and used for these purposes.

3.2. The legal bases for processing your personal data are, on the one hand, contract fulfillment (online purchase), legitimate interests, and the fulfillment of our legal or contractual obligations, and on the other hand, your consent (contact form, newsletter, cookies). Failure to provide the data can have various consequences.

3.3. We process your personal data (name, address, payment data, as well as optional delivery address, company name, phone number (mobile and/or landline), fax number) as far as necessary, for the duration of the entire business relationship (from the initiation and processing to the termination of a contract) as well as beyond that in accordance with the legal retention and documentation obligations resulting from, among others, the Austrian Commercial Code (UGB) and the Federal Fiscal Code (BAO), and until the end of any legal disputes, ongoing warranty and guarantee periods, etc.

3.4. As part of operating our websites, we commission Martin Zinke (IT service provider), who could gain access to your personal data in the course of his activities, provided he needs the data to fulfill the respective service. He has committed to us to comply with the applicable data protection regulations. A data processing agreement has been concluded in accordance with Art. 28 GDPR.   1. Contact Form

4.1. Your details, including personal data from our contact form, will be transmitted to us via our own mail server to process your inquiry, further processed, and stored by us. This data will not be collected or passed on without your consent. Without this data, we cannot process your inquiries.

4.2. Data processing is carried out on the basis of the legal provisions of § 96 Para. 3 TKG as well as Art. 6 Para. 1 lit. a (consent) GDPR.

  1. Newsletter

5.1. You can register for our newsletter on the website; this is done using a double opt-in process. After registering, you will receive an email asking you to confirm your registration. Without providing this data, the delivery of our newsletter is not possible. You can unsubscribe from the newsletter by clicking the unsubscribe link at the end of each newsletter.

5.2. We commission data processors to send our newsletter. They have committed to us to comply with the applicable data protection regulations. 5.3. Data processing is carried out on the basis of the legal provisions of § 96 Para. 3 TKG as well as Art. 6 Para. 1 lit. a (consent) GDPR.

  1. Online Purchase

6.1. We would like to point out that for the purpose of a simpler shopping process and for subsequent contract processing, the webshop operator, Vigor Fitness, stores the IP data of the connection holder within the framework of cookies, as well as the name, address, payment data, and optionally the delivery address, company name, phone number (mobile and/or landline), and fax number of the buyer. In addition, the following data is also stored by us for the purpose of contract processing: name, address, payment data, and optionally the delivery address, company name, phone number (mobile and/or landline), and fax number. The data provided by you is necessary for contract fulfillment or for the implementation of pre-contractual measures. Without this data, we cannot conclude the contract with you.

6.2. A transfer of the data (name, address, payment data, and optionally delivery address, company name, phone number (mobile and/or landline)) takes place to [e.g., the processing banking institutions/payment service providers] for the purpose of [debiting the purchase price, to the transport company/shipping company commissioned by us] for the purpose of [delivery of the goods, as well as to our tax advisor] for the purpose of [fulfilling our tax law obligations]. These parties have committed to us to comply with the applicable data protection regulations. A data processing agreement has been concluded in accordance with Art. 28 GDPR. 6.3. Data processing is carried out on the basis of the legal provisions of § 96 Para. 3 TKG as well as Art. 6 GDPR (in particular consent and/or necessity for contract fulfillment).

  1. Cookies, Other Tracking Tools, and Web Analysis

7.1. Cookies, other tracking technologies, and functions of the web analysis service Google Analytics (Google Inc., 1600 Amphitheatre Parkway Mountain View, CA 94043, USA) can be used on our internet platform in a variety of ways. Cookies are small pieces of text information that make it possible to recognize the user and analyze your use of our websites. The information generated in this way is transferred to the provider’s server and stored there. They serve to make our overall internet presence more user-friendly, effective, and secure. In addition, cookies are used to measure the frequency of page views and for general navigation.

7.4. Your IP address is recorded but immediately pseudonymized by deleting the last 8 bits. This means that only a rough localization is still possible.

7.6. Data processing is carried out on the basis of the legal provisions of § 96 Para. 3 TKG as well as Art. 6 GDPR (in particular consent). Since the privacy of our users is important to us, user data is pseudonymized.

  1. Consent and Right of Withdrawal

8.1. If your consent is necessary for the processing of your data, we will only process it after your express consent.

8.2. In principle, we do not process data of minors and are not authorized to do so. By giving your consent, you confirm that you have reached the age of 14 or that the consent of your legal representative is available.

8.3. You can withdraw your consent at any time at the following email address: christian.binder@vigor-fitness.at. In such a case, the data previously stored about you will be anonymized and subsequently used only for statistical purposes without personal reference. The withdrawal of consent does not affect the lawfulness of the processing carried out on the basis of the consent until the withdrawal.

9.1. Peter Gindl uses technical and organizational security measures to protect the stored personal data against accidental or intentional manipulation, loss, or destruction and against access by unauthorized persons. Our security measures are continuously improved in line with technical progress.
